New Passenger Transport Regulations 2024From 1 September 2024, the Passenger Transport Regulations 2024 (2024 Regulations), made under the Passenger Transport Act 1994 (the Act) have commenced. The 2024 Regulations replace the Passenger Transport Regulations 2009 (2009 Regulations), which were scheduled to expire on 1 September 2024 under the operation of the Legislative Instruments Act 1978. The 2024 Regulations largely replicate the 2009 Regulations, with minor updates made to replace superseded legislation references, adopt gender-neutral language and re-number provisions. The 2024 Regulations contain transitional provisions in Schedule 5 to enable legislative instruments made under the 2009 Regulations, including Ministerial determinations concerning passenger transport fares and recognised concession cards, to continue to operate. The updated Regulations can be accessed here. Passenger Transport Act ReviewThe report on the Passenger Transport Act Review was released on 30 August 2024. The Department for Infrastructure and Transport is working with industry and key stakeholders to progress changes to the Passenger Transport Act 1994 in line with key recommendations in the review and supported by a Taxi Industry Reform Package. Following the stakeholder consultation currently underway, the next step to progress implementation of the review recommendations is to introduce a Bill into South Australian Parliament to amend the Passenger Transport Act 1994. The Department for Infrastructure and Transport (the Department) will then be releasing guidelines that set out how taxi licence owners can apply for a payment under the Taxi Industry Reform Package. The Department will write to all taxi licence owners to provide a copy of the guidelines and outline the process. More information on the Taxi Industry Reform Package and progress on delivering the other recommendations will also be published on the Department’s P2P website at www.dit.sa.gov.au/point_to_point_transport/p2p.
