About this document

An essential infrastructure development application form is an approved form under section 130 of the Planning, Development and Infrastructure Act 2016 (the Act) and regulation 104A(2) of the Planning, Development and Infrastructure (General) Regulations 2017.

Essential infrastructure is a type of development that is undertaken by a prescribed person as defined in regulation 3CA, where the Minister for Planning is the decision maker.

In order to undertake an essential infrastructure proposal, a development application must be lodged with the State Planning Commission who through their delegate, the State Assessment Commission Panel (SCAP), assess the application and provide advice to the Minister. This form outlines a summary of the proposed essential infrastructure development, including applicant and location details and an estimated development cost.

After receiving the advice of the SCAP, the Minister decides whether to approve or refuse the application. The Minister may also impose conditions or approve all or part of a development. There is no appeal right against the Minister’s decision.

This development application form is not required if you are lodging an application electronically. Direct lodgement into the DAP is currently being developed.
